General Terms of Sale
I. Application and enforceability of the general conditions of sale
1.1. The present general conditions of sale are brought to the attention of each customer to enable him to place order.
1.2. Consequently, placing an order implies the full and unreserved acceptance of these general terms and conditions of sale by the customer.
1.3. No special conditions or other general conditions issued by the customer may prevail over these conditions without the express agreement of francis-miot.com.
1.4. Any contrary conditions imposed by the customer will therefore, in the absence of express acceptance, not apply to francis-miot.com, regardless of when it may have been brought to its attention.
1.5. The fact that francis-miot.com does not avail itself at any time of any of the present general conditions of sale, cannot be interpreted as a renunciation to avail itself subsequently of any of the said conditions.
II. Order Taking and Confirmation
2.1. The customer undertakes to complete the purchase order accurately and to fill in the various existing sections (address, delivery address, payment method, etc.). In case of error in the wording of the recipient’s contact details, francis-miot.com cannot be held responsible for the impossibility of delivery to the recipient. The cost of re-routing the package to another recipient or to a new delivery address will be borne by the customer.
2.2. Each product request is subject to the acceptance of francis-miot.com . francis-miot.com reserves the right to reject any order due to insufficient stock, incomplete customer information, or any other legal reason. We undertake to inform you within two (2) business days of your order if we encounter a problem to honor your order.
2.3. Right of withdrawal: In accordance with articles L. 221-23 to L. 221-25, the customer has 14 days to exercise his right of withdrawal, without having to give reasons for the reason. This period runs from the date of delivery of the order. For this, in accordance with the regulations (art L221-23), the customer completes the withdrawal form below, and returns the products to us at his expense within 14 days after the sending of the form. The refund of the initial order (including the standard transport cost) will be made once the goods have been received. It will be done using the same means of payment as that used for the passage of the order.

III. Price
3.1. The prices indicated on the order form are in Euros TTC, from our factory in Uzos.
3.2. Delivery charges are extra. Delivery rates depend on the destination location, weight and volume of the package. They include a contribution to the cost of preparing the package and to the transport costs themselves. For more information about these rates, you can contact us.
IV. Payment on Order
4.1. Payment is made in cash online by credit card: Carte Bleue, Visa, Eurocard, Mastercard, JCB, American Express. For this reason, discount conditions and late payment penalties are not applied.
4.2. The currency used for the transaction is the Euro.
V. Unavailability of products
The availability of the products and services is given on the site in an indicative way. It becomes definitive only on confirmation of the order. Francis-miot.com cannot be accused of the unavailability of a product in the delivery, insofar as the customer has had the information prior to the delivery of his order.
VI. Delivery of products
6.1. Product Preparation and Routing.
6.1.1. Packages are prepared and packaged by francis-miot.com in a closed, resistant package, suitable for the contents and transport requirements.
6.1.2. THE CUSTOMER IS RESPONSIBLE FOR THE INFORMATION RELATING TO THE NAME AND ADDRESS OF THE CONSIGNEE, WHICH MUST BE PRECISE, EXACT AND COMPLETE (DOOR CODE, FLOOR, TELEPHONE PORT, MAIL, etc.) IN ORDER TO ALLOW DELIVERY UNDER NORMAL CONDITIONS. francis-miot.com cannot be held responsible for a return of delivery due to an address error or an inability to deliver to the indicated address. IF THE RETURN OF DELIVERY OR INABILITY TO DELIVER IS DUE TO A LACK OF INFORMATION OR ADDRESS ERROR, THE RE-DELIVERY WILL BE INVOICED IN FULL TO THE CUSTOMER.

Any abnormalities during delivery must be reported on the delivery note and communicated to us before 10 days. Without compliance with this clause, no refund procedure with the selected carrier may be initiated.
6.1.5. IN CASE OF ABSENCE OF THE CONSIGNEE OR OF A PERSON WHO MAY TAKE POSSESSION OF THE PRODUCTS AT THE TIME OF DELIVERY, THE CARRIER WILL ISSUE A DELIVERY NOTICE TO THE DELIVERY ADDRESS INDICATED BY THE CUSTOMER INVITING THE CARRIER TO PICK UP THE PRODUCTS IN A PARCEL RELAY NEAR THE INITIAL DELIVERY LOCATION. Under no circumstances shall francis-miot.com be liable for any deterioration of the products as a result of their late withdrawal from the carrier.
6.1.6. The Order Preparation Logistics Centre can be found at francismiot.com – D37 – Uzos Roundabout – 64110 UZOS. This logistics centre manages orders for Metropolitan France.
6.2. Delivery times.
6.2.1. Delivery times depend on the destination address and time of year. On the summary page of my order, the earliest date we can deliver your order is offered to you.
6.2.2. The proposed date is guaranteed :
• except in cases of force majeure,
• except in the event of a carrier strike,
• provided the delivery address is accurate, right and complete,
• provided that the recipient of the order is present at the time of delivery.
6.2.3 This proposed date is guaranteed for orders placed between Mondays and Thursdays (excluding French public holidays) before 12:00 (noon), Paris time and deliveries are made on working days other than public holidays. NO DELIVERIES CAN BE MADE ON SATURDAY AND SUNDAY
ATTENTION: ALL ORDERS PLACED ON FRIDAY, SATURDAY AND SUNDAY WILL BE SHIPPED ON THE FOLLOWING MONDAY AND THEREFORE DELIVERED FROM TUESDAY ONLY. In times of high activity, deadlines cannot necessarily be guaranteed.
VII. Transfer of Ownership – Transfer of Risk
7.1. The transfer of ownership of the products for the benefit of the customer takes effect only after complete payment of the price by the customer.
7.2. francis-miot.com insures the risk of loss and deterioration of the products until delivery of the said products to the consignee. The transfer of risks therefore takes place from the moment the consignee has acknowledged receipt of the products, knowing that they will be delivered at the latest 30 days after the actual payment of the order.

8.2. Upon receipt of the products, the customer must ensure the conformity of the delivery with his order. Any damage must be subject to precise reservations, dated and signed, on the delivery slip.

8.4. This claim must be justified and accompanied by proof of the damage suffered (air waybill, photo of the package received, etc.). After the analysis and acceptance of the claim by francismiot.com, the customer can choose between the refund of his order or a re-delivery.
IX. Returns
9.1. Any return of the product must be the subject of a formal agreement between francis-miot.com and the customer and be returned within 48 hours of the agreement. After this period, no return can be taken into account.

When you purchase, we only ask you for the necessary information (surname, first name, full address, e-mail) for quality processing and careful monitoring of your order. XI. Prohibitions
The customer must not in any case resell the products that are intended for his personal use or that of the recipient of his order.
XII. Loyalty points
Our loyalty program allows you to obtain the equivalent of €1 discount, all 25€ including all taxes. These awards are valid for 12 months (365 days to be precise), if not used. Shipping costs and promotional products are not included in this calculation.

XIII. Sponsorship
The sponsorship is done when the godson registers for the first time after receiving the invitation of the sponsor by email.
Sponsorship is automatic once the invitation has been sent by the sponsor. No sponsorship may be taken into account after registration or otherwise than through it.

Is considered as a sponsored party any natural person registering for the first time on www.francis-miot.com. The sponsor and sponsor party cannot be the same person or be part of the same household (home).
Once the sponsor’s invitation is sent, the sponsor party receives an email with a discount code of 10% valid on the whole site www.francis-miot.com (excluding shipping costs and without time limit) he can register and place his first order by entering the discount code in the box provided for this purpose. This code is valid for the first command of the sponsor party, and only this one.
Once the first order of the sponsor party is registered and paid on www.francis-miot.com, the sponsor will have his account credited with 100 loyalty points equivalent to a voucher of 5€. The latter is usable after the first order validated and paid by its sponsor party. The €5 voucher can be used on the whole www.francis-miot.com site (excluding shipping costs and without time limit).
It is possible to sponsor several people and to accumulate the vouchers. However, the shipping costs remain at the expense of the customer.
Sponsorship is limited to a restricted circle (relatives, friends) of actual and physical knowledge. Consequently, the massive recruitment of sponsor parties outside this framework, for directly or indirectly lucrative purposes, or even free of charge, by any means and in particular via a website, a blog, Internet ads or discussion forums is strictly prohibited. All forms of mass sponsorship, regardless of the medium, are prohibited. Self-sponsorship activities for which the participant registers with different email addresses in order to carry out a fictitious sponsorship allowing him to obtain benefits are also prohibited.
If www.francis-miot.com identifies abuse of use by a client (sponsor or sponsor party) in this sponsorship, www.francis-miot.com and its representatives will be able to take the necessary measures to stop these abuses and to cancel accordingly the benefits and other reductions that would have been improperly attributed to this customer, to claim the refund of the benefits already received.
